Nick Smith, a lawyer for Ethan Nordean – one of the defendants in the case – argued that Trump’s comments didn’t reflect any of the actions his client and the four other defendants are alleged to have taken during the conspiracy, and that the infamous comment would be unduly prejudicial with the jury.

(District Judge Timothy) Kelly rejected the argument, noting that defendant Enrique Tarrio, the then chairman of the Proud Boys and a defendant in the trial, tweeted, “standing by, sir” immediately after the debate.


Good call by the judge.

“This stays only between us,” Kremer told Mike Lindell, the MyPillow CEO, in a Jan. 4 text exchange that the committee obtained. “We are having a second stage at the Supreme Court again after the Ellipse. POTUS is going to have us march there/the Capitol.

“It cannot get out about the second stage because people will try and set another up and sabotage it,” Kremer continued. “It can also not get out about the march because I will be in trouble with the National Park Service and all the agencies, but POTUS is going to just call for it ‘unexpectedly.’”

A Mississippi man who was among the first rioters to reach the Capitol Rotunda on January 6 has been sentenced to 78 months in federal prison for assaulting police officers guarding the U.S., the Department of Justice reported.

James McGrew, 40, of Biloxi, Mississippi and Carlsbad, California, also was ordered by U.S. District Court Judge Beryl A. Howell to serve 36 months of supervised release and pay a $5,000 fine and $2,000 in restitution. McGrew pleaded guilty last May 13 to felony assault.

As Cheney observes on Twitter, the latest Oath Keepers guilty verdict "has to produce anxiety" for Proud Boys leader Enrique Tarrio, who himself is facing seditious conspiracy charges.

"Like [Oath Keeper Ed] Vallejo, he wasn’t even in DC on Jan. 6, but jurors agreed Vallejo participated in the seditious conspiracy from a Comfort Inn in Arlington, where he babysat a stockpile of weapons," he writes.
