Federal Judge in Texas shoots down eviction moratorium.

Leave it to Texas to rule this way.

"The federal government cannot say that it has ever before invoked its power over interstate commerce to impose a residential eviction moratorium. It did not do so during the deadly Spanish Flu pandemic. Nor did it invoke such a power during the exigencies of the Great Depression. The federal government has not claimed such a power at any point during our Nation's history until last year," Barker wrote.

 
My first question would be what about WWII and WWI?
If we're going to use historical events then the 1918 pandemic and Great Depression certainly do not cover all instances of possible government interference.

Were families of serving members allowed to be evicted during the wars would be my first question?

Otherwise, in regards to your state/federal separation...
 
It's a slippery slope. Basically, the Federal Government can claim jurisdiction because most of the banking entities that hold these mortgages/loans conduct business across state lines, making it interstate commerce, making it fair game for the federal government.

This idiot judge is using the argument that since it's never been done before it should never be done. That's wrong on so many different levels I don't know where to begin.

Banks are regulated by the Federal Government. Full stop. As such, they are subject to whatever restrictions the Federal Government places on them within reason.

It's not like the Feds are saying, "You get no money, screw you". They're simply saying, "Hold off for 6 months and give people time to get back on their feet. They still owe you the money, just give them a chance to catch up."

I'll bet a million dollars I don't have that this particular judge is involved up to his neck in real estate.
