Fall on walk from bed to desk is workplace accident, German court rules

A German court has ruled that a man who slipped while walking a few metres from his bed to his home office can claim on workplace accident insurance as he was technically commuting.
The man was working from home and on his way to his desk one floor below his bedroom, the federal social court, which oversees social security issues, said in its decision.
While walking on the spiral staircase connecting the rooms, the unnamed man slipped and broke his back.
It is not clear if the man was working from home due to the pandemic or had done so previously. The ruling said the law applied to “teleworking positions”, which are “computer workstations that are permanently set up by the employer in the private area of the employees”.

I'm wondering how on earth he could possibly establish that he was in fact on his way to do work. How do we know he wasn't on the way to get a sandwich or beer? It seems pretty easy to cop a claim no matter what with that situation.

Which is why they established that he did not have breakfast before going to the workstation.
 

A Quebec labour judge has ruled that an Air Canada call centre employee who hurt herself going down a staircase while working from home suffered a workplace injury and merited worker’s compensation.

The ruling, handed down by Quebec administrative Judge Philippe Bouvier earlier this month, seems to be the first in the province to confirm that an injury that occurs during work hours in the home of an employee teleworking due to COVID-19 is eligible for worker’s compensation, according to experts.

Not only Germany it seems.
