Giuliani was at the rally where President Donald Trump is accused of inciting an insurrection — and where Giuliani advocated "trial by combat."

Rudy Giuliani now says he won't be a part of President Donald Trump's impeachment defense team.

Calling himself a "witness," the president's personal attorney told ABC News' chief White House correspondent, Jonathan Karl, that he could not defend Trump against the charge of inciting an insurrection because he attended — and spoke at — the event at the center of the allegation.

I've got a joke about that. It's bad. But here goes:

So a man that had been white collar his entire life gets busted for tax fraud and sent to jail. He'd never even been in a holding cell before, but here he is headed to a federal penitentiary.

So they walk him in, down the long row of cells and they get to his cell and there's this big, huge black guy sitting on the other bunk looking at him.

The guards lock the cell shut and walk away. The big fella is just sitting there looking at him.

So the fellow starts putting his few items away, makes his bunk and sits down on it. Finally, the big guy speaks:

Big Guy: You done?
Fellow: Ummm...yeah.

Big Guy: Good. I wanted you to get settle in before I explained the rules to you.
Fellow: Rules?

Big Guy: Yeah. Rules. In here, we got rules. In here, we play house.
Fellow: House?

Big Guy: Yeah. House. Now then, do you want to be the momma or do you want to be the daddy?

The fellow is horrified. He thinks "be the momma? oh God no I could never do that!" So finally, wincing, he says:
